Terms of Service

These terms govern website design and build services provided by Nimbus Web Studio (“Nimbus,” “we,” “us”) to you (“Client,” “you”). Paying the project fee means you agree to these terms.

1. What you get

A professionally built website using the pages your business needs, built from content and information you provide, plus the revisions included in your plan. The finished site goes live once you have reviewed and approved it.

We offer three plans, and the one you bought is the one that applies:

2. Payment

The project fee is paid in full, up front, by card through our secure Stripe checkout. Payment is what starts your build. On Launch and Grow the project fee is a one-time charge with no required monthly fee; Command additionally requires an ongoing monthly subscription, disclosed before you buy (see section 7). Your first year is included in the project fee; any renewal or optional plan that follows is separate and clearly disclosed before you are charged.

3. Timeline & your content

We aim to deliver your site live within about 7 days of receiving your content and payment. That timeline depends on you providing the needed materials (text, photos, business details, and any logins) promptly. If we do not receive what we need within 30 days of payment, the project may be paused; we will resume when your materials arrive.

4. Revisions & scope

Your build includes the revisions listed for your plan in section 1. Requests beyond the agreed scope, or after launch, are handled separately — either under your plan's updates coverage or by direct arrangement with Jake. We will always tell you in advance if something falls outside the included work.

"Small updates," where your plan includes them, means text and photo changes to existing pages. New pages, new features, redesigns, and integrations are new work and are quoted separately.

5. Cancellation & refunds

You may cancel before your site goes live. Because work begins immediately on payment, a cancellation refund reflects work already completed: if we have not yet started your build, you receive a full refund; once design work has begun, the fee covers that work and is non-refundable in part or full at our reasonable discretion. After your site is live and approved, the project is complete and the fee is non-refundable. Chargebacks filed without first contacting us to resolve an issue will be disputed with reference to these terms and your approval record.

6. Ownership

When your project is paid and complete, the finished website and its content are yours. We build in plain, portable code — no proprietary page-builder lock-in — so your site can move with you if you ever leave.

Command works differently, and we want to be plain about it. Your business data — your customers, jobs, and records — is always yours, and we will export it to you in a standard format on request, including if you cancel. The customer-management platform and app themselves are our software, licensed to you for as long as your subscription is active, not sold to you. If the subscription ends, your website remains yours and you keep your exported data, but access to the platform and app ends.

7. First year, renewal & care plans

Your first year is included in the project fee — the site being set up and live for twelve months from launch costs you nothing beyond the project price. What happens after that depends on your plan:

Every renewal and plan price is disclosed to you in writing before you are charged, and you may decline any renewal. Your website is yours either way (see section 6).

8. Acceptable use & content

You confirm you have the right to use any text, images, logos, and materials you provide, and that your business and its content are lawful. We may decline or stop work on content that is illegal, infringing, or abusive.

9. Liability

We provide our services with reasonable care and skill. To the extent permitted by law, our total liability for any claim relating to the project is limited to the amount you paid for it. We are not liable for indirect or consequential losses.
